JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 23-01-2017 Heard learned counsel for the petitioner and counsel representing the State.
The petitioner apprehends his arrest in connection with Parwatta P.S. Case No. 155 of 2016, registered for the offences punishable under Sections 341, 323, 324, 307/34 of the Indian Penal Code.
Allegedly, there was Tilak ceremony of the son of Anil Das. Some water fell on the body of Sunil Kunwar, due to which some altercation took place. On such, Pappu @ Navin Kunwar ordered to assault the informant and then Nand Kishore Kuwar assaulted Sunil Kunwar with water pot and the petitioner assaulted Sunil Kuwar, the brother of the informant, with khanti on his head.
Patna High Court Cr.Misc. No.2220 of 2017 (2) dt.23-01-2017 2/2 Submission is of false implication and that there is case and counter case bearing Parwatta P.S. Case No. 161 of 2016. The petitioner has also received injury, there is no injury report of Sunil Kunwar. The occurrence has taken place due to sprinkling of water after taking feast and in this case co-accused Pappy Kunwar @ Naveen Kunwar has already been allowed bail vide Cr. Misc. No. 46745 of 2016 by another co-ordinate Bench of this Court.
In the facts and circumstances as stated above, considering that there is case and counter case and due to petty dispute the occurrence has taken place and, as such, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Khagaria, in connection with Parwatta P.S. Case No. 155 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.)
