JUSTICE SUDHIR SINGH ORAL ORDER 22-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 363 and 366A of the I.P.C. The prosecution case, in short, is that on 29.9.2015 at 6 A.M. the daughter of the informant had gone to tuition, but when she did not return till 10 A.M. the informant started searching her. In course of search, the informant learnt that the petitioner with the help of others abducted the daughter of the informant. The informant claimed that the petitioner and others abducted her daughter due to bad intention.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 7.10.2015 and the charge sheet has been submitted in the present case. The petitioner has got no
Patna High Court Cr.Misc. No.31802 of 2016 (3) dt.22-09-2016 criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The victim girl has admitted in her statement recorded under Section 164 Cr.P.C. regarding the court marriage with the petitioner. The other coaccused has been granted bail vide Annexure-3 to the present application.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Katihar in connection with Manihari P.S. case No.138 of 2015.
