It is submitted by learned counsel for the petitioner that in the said order, the pendency of the case in the learned court of SDJM, Masaurih, Patna was wrongly described in the petition of Cr. Misc. No.1487/2024 rather the same is pending consideration in the learned court of Sub-Judge-cum-ACJM, Masaurih. Learned counsel for the petitioner further prays for extention of time for the petitioner to surrender before the learned Court of Sub-Judge-cum-ACJM, Masaurih. 3.

Considering the submission of learned counsel for the

Patna High Court CR. MISC. No.24027 of 2024(2) dt.27-03-2024 2/2 petitioner, the order dated 07.02.2024 passed in Cr. Misc. No.1487/2024 is modified to the extent that at para -2, the Court name be read as 'learned Court of Sub-Judge-cum-ACJM, Masaurih' in place of 'learned S.D.J.M., Masaurih, Patna'. 4.

Further, in the interest of justice, the period of surrender for the petitioner before the learned Court of Sub-Judge-cumACJM is extended by four weeks from the date of receipt/production of a copy of this order in connection with Masaurih P.S. Case No.42 of 2013, pending in the court of learned Sub-Judge-cum-ACJM, Masaurih.

The order dated 07.02.2024 passed in Cr. Misc. No.1487/2024 is modified to the extent as indicated above and rest of the order shall remain intact.

Accordingly, this modification application stands disposed of.
