The petitioner apprehends his arrest in connection with Hulasganj P.S. case No. 17 of 2016 instituted under Sections 452,302, 364/34 of the Indian Penal Code. The allegation, in brief, is that accused persons assaulted the informant and his mother. Specific allegation of assault on the mother of the informant is against Lalan Sao. It is further submitted that both sides are agnates and also have land dispute and therefore, the petitioner has been falsely implicated in this case. There is no allegation of assault upon the deceased by him. The allegation is against his father that he put his leg upon the neck of the mother of the informant who in the result died and this petitioner is a student. Co-accused Baby Devi and

Patna High Court Cr.Misc. No.5422 of 2017 (2) dt.07-02-2017 Rubi Kumari have been granted bail by a co-ordinate bench of this Court in Criminal Miscellaneous No. 40539 of 2016. Having considered the land dispute against the parties and no allegation of assault by the petitioner to the deceased, let the petitioner, namely, Sonu Kumar in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Hulasganj P.S. case No. 17 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
