2. The petitioner seeks anticipatory bail in connection with Chanpatia P.S. Case No. 725 of 2023 registered for the offence under Sections 147, 149, 341, 323, 324, 325, 307, 379, 504 of the Indian Penal Code.
3. As per the prosecution case, the petitioner is said to have assaulted the victim Majhar Alam.
4. It has been submitted by the learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner is bright student who has done Zoology(Hons.).
5. It has further been submitted by the learned counsel for the petitioner that the there is admitted land dispute
Patna High Court CR. MISC. No.23024 of 2024(3) dt.28-06-2024 2/2 between the parties for which a title suit is also pending and the victim (Majhar Alam) has sustained a contusion i.e. is simple injury.
6. Considering the aforesaid facts, this application is allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran at Bettiah, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
