Petitioners are apprehending arrest in connection with Special POCSO Case No. 134 of 2017 arising out of Naubatpur P.S. Case No. 265 of 2017 for the offence under sections 354, 323, 504, 506/34 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners and the informant belong to same locality. The petitioners have no criminal antecedent. He further submitted that parties have entered into a compromise and settled their disputes.
Considering the aforesaid, let the petitioners, named
Patna High Court Cr.Misc. No.62558 of 2018(2) dt.12-12-2018 2/2 above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-1, Patna (Special Judge POCSO Act) , in connection with Special POSCO Case No. 134 of 2017 arising out of Naubatpur P.S. Case No. 265 of 2017 subject to the condition that before releasing the petitioners, the Court below has to verify the factum of compromise between the parties and only after statement of the informat, the court below will release the petitioners with other condition as laid down under section 438(2) of the Cr.P.C.
