03.09.2020 Heard the counsel for the parties.
The petitioners seek bail in anticipation of their arrest in connection with Kateya P.S. Case No. 238 of 2019 dated 06.07.2019 instituted for the offence under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code.
The petitioner no. 1 is said to have purchased a plot of land and petitioner no. 2 is the witness to the sale deed. The accusation in the F.I.R is that the land was purchased by them knowing fully well that the vendor did not have the title of the land.
It has been submitted on behalf of the petitioners that they were made to understand that the vendor was the real owner of the property. The entire purchase has been made on consideration. There appears to be a private dispute between the family members of the vendor and the informant is non else but the widow aunt of the vendor. Considering the nature of accusation against the petitioners, they are directed to be released on bail, in the event of their arrest or surrender before the court below on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) each with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -XV, Gopalganj in connection with Kateya P.S. Case No. 238 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
