JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-07-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 20(b)(ii)(c), 27(a), 23(c), 29 of the N.D.P.S. Act.

Total 363.45 Kg of ganja has been recovered from the truck of the petitioner.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has got no criminal antecedent. Learned counsel for the State opposes the prayer for bail. There is specific allegation against the petitioner that he is owner of the vehicle in question from which the huge quantity of ganja has been recovered.

Patna High Court CR. MISC. No.24421 of 2023(2) dt.06-07-2023 2/2 Considering the fact that huge quantity of ganja has been recovered from the vehicle, of which the petitioner is the registered owner, prayer for pre-arrest bail of the petitioner is rejected.
