JUSTICE ARVIND SRIVASTAVA ORAL ORDER 28-01-2017 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner apprehends his arrest in connection with Purnahiya P.S. Case No. 32 of 2016 registered under Sections304B/34 of the Indian Penal Code. The allegation against the petitioner, who is Devar of the deceased, is of torture and assault due to non-fulfillment of demand of dowry. Ultimately, the deceased was done to death.

Learned counsel for the petitioner submits that there is no specific allegation against this petitioner rather the allegations levelled are general and omnibus in nature. It is further submitted that earlier final form was submitted against

Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Sheohar in connection with Purnahiya P.S. Case No. 32 of 2016 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
