The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341, 342, 323, 353, 504 and 427/34 of the Indian Penal Code and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
The prosecution case is that the accused persons humiliated the Junior Electrical Engineer by abusing caste name and snatched the government papers.
It is submitted by learned counsel for the petitioners that since the protest was being made for disruption in the
Patna High Court Cr.Misc. No.37737 of 2015 (2) dt.18-09-2015 2/2 electricity supply, hence, the accusation has been levelled and the accusation is omnibus and general.
The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Manjhagarh P.S. Case No.51 of 2015, pending before the learned Judicial Magistrate, 1st Class, Gopalganj. With the above observation, this application is, accordingly, disposed off.
