JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-08-2016 Petitioner is permitted to make necessary correction in paragraph-1 of the petition within the course of day. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 47 of the Excise Act.

In huge quantity country made liquor was recovered from the haystack kept in the Khalihan of the petitioner but learned counsel for the petitioner submits that in paragraph-21 of the case diary, it has come that adjacent to the Khalihan of the petitioner, there was an old Pub and, therefore, there was every possibility that the owner of the aforesaid Pub had concealed seized articles in the Khalihan of the petitioner.

No.35044 of 2016 (2) dt.22-08-2016 2/2 Petitioner was neither caught on the spot nor anything was recovered from his conscious possession and apart from this, petitioner does not have any criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Kaimur at Bhabua in connection with Kudra P.S. Case No.85 of 2016.
