The petitioner apprehends his arrest in connection with Pirbahore P.S. Case No. 86 of 2016 registered for the offence punishable under Sections 409, 420 of the Indian Penal Code. Two bodyguards of a private person namely, Vikash Chandra Guddu Baba apprehended an employee of P.M.C.H. namely, Bindeshwar Prasad who was found carrying a bag containing some medicines and other articles of the P.M.C.H. He was produced before Superintendent of the P.M.C.H. and thereafter the present case has been lodged.
The allegation against this petitioner is that she and one other sister in-charge of maternity wards had connection with the said Bindeshwar Prasad.
Learned counsel for the petitioner submits that this petitioner is a senior Nurse in maternity wards and she has no
Patna High Court Cr.Misc. No.13121 of 2017 (2) dt.18-03-2017 2/2 concern with any recovery made from Bindeshwar Prasad. The alleged recovery was made outside the hospital campus. Besides that there is nothing specific against the petitioner. The coaccused Bindeshwar Prasad has been allowed regular bail by a co-ordinate Bench of this Court vide order dated 14.07.2016 passed in Cr. Misc. No. 27072 of 2016. He further submits that the petitioner has clean antecedent and she is suffering from cancerous diseases.
Learned APP, on the other hand, prayed for calling for the case diary.
Considering the nature of allegation as also the fact that there is nothing specific against the petitioner, the prayer of anticipatory bail is allowed. The petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be admitted on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Pirbahore P.S. Case No. 86 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sanjay Kumar, J) rohit/- U T
