JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-09-2020 The defect as pointed out by the office be ignored. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 414 of the Indian Penal Code and 25(1-b)a, 26,35 of the Arms Act.

One country made pistol, two live cartridges, Motorcycle and Mobile phone are said to have been recovered from possession of the petitioner, who is languishing in jail custody since 14.04.2019. Moreover, petitioner does have criminal antecedent of seven cases which has been averred in Para- 3 of the petition.

However, learned counsel for the petitioner submits

No.20725 of 2020(2) dt.04-09-2020 2/2 that nothing was recovered from conscious possession of the petitioner and as a matter of fact, he has been implicated not only in present case but in several other cases. He further submits that petitioner has sufficiently been punished by remaining in jail custody for more than one year and there is no possibility of conclusion of trial of the petitioner in near future due to present pandemic situation.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran in connection with Harsidhi P.S. Case No. 119 of 2019.
