ANJANA MISHRA ORAL ORDER 28-09-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 24.07.2018 in connection with Narpatganj (Bathnaha) P.S. Case No.445 of 2018, G.R. No.2382/18 registered for the offence under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that, admittedly, the informant is not an eye-witness to the case and the allegations as made out are wholly based on suspicion. The petitioner is not having any criminal antecedent and has been named in connection with the present case only on the basis of suspicion and malicious co-villagers.

No.59464 of 2018 (2) dt.28-09-2018 2/2 Considering the aforementioned facts and circumstances of the case and that, admittedly, the informant is not the eye-witness and also that the petitioner is not having any criminal antecedent, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, in connection with Narpatganj (Bathnaha) P.S. Case No.445 of 2018, G.R. No.2382/18.
