Mr. Bharat Bhushan, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 30-04-2025 Heard Mr. Mritunjay Kumar, learned counsel for the petitioner and Mr. Bharat Bhushan, learned APP for the State.

2. Petitioner seeks regular bail in connection with Pothia P.S. Case No. 158/ 2024 dated 29.06.2024 registered for the offence(s) punishable under Section(s) 341, 323, 325, 307 read with section 34 of the IPC.

3. The main submissions advanced by the petitioner's counsel are that there is no specific allegation against the petitioner and he and co-accused, Bappi Ray are alleged to have assaulted at the head of the informant by means of an iron rod, though, as per prosecution, the informant sustained head injury but as per the order impugned, the concerned doctor opined that the said head injury may be grievous, so, there is no definite opinion by the doctor about the grievousness of the said injury.

Patna High Court CR. MISC. No.21508 of 2025(2) dt.30-04-2025 2/2 It is further submitted that the petitioner has been languishing in jail since 28.11.2024, having fair and clean antecedent and investigation against him has been completed.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

5. In the facts and circumstances of this case and considering the aforesaid submissions advanced by the petitioner's counsel and the custody period of the petitioner as well as completion of investigation against him, this court is inclined to grant the relief of regular bail to the petitioner. Accordingly, let the petitioner named-above be released on bail in connection with Pothia P.S. Case No. 158/ 2024 on furnishing bail bond of Rs. 20,000/- ( Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
