JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Trial No. 2573 of 2020 (arising out of Excise P.S. Case No. 24 of 2019), registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that on receiving secret information about keeping of liquor by Mantu Singh @ Mintu Singh (Petitioner) in Chawar at village-Dhamapar, the excise officials reached there. While on seeing the excise officials, Mantu Singh @ Mintu Singh (Petitioner) succeeded to flee away, but, on search, 3600 bottles, each containing 180 ML and 450 bottles, each containing 200 ML Indian made foreign liquor recovered from a barren Chawar concealing in the

Learned counsel for the petitioner submits that it would appear from the report of Excise officials that the alleged bottles of Indian made foreign liquor recovered from open field (Chawar), concealing in the grass, not from the house of the petitioner and the petitioner was also not apprehended from the spot. Further submission is that, in fact, the petitioner is accused in three other cases of similar nature, as detailed in paragraph No.3, due to that reasons, the petitioner has falsely been implicated in this case by the excise officials. The petitioner is in custody since 05.02.2020. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II-cum-Special Judge, Excise Gopalganj in connection with Excise Case No. 24 of 2019.
