JUSTICE SUDHIR SINGH ORAL ORDER 08-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 394 of the Indian Penal Code and 27 of the Arms Act. Allegation is that while informant along with the guard of the company, where he works as Manager, was going to deposit money to the tune of Rs.13,97,000/- in the bank, three miscreants snatched the bag containing money and the rifle, fired upon the guard and fled away.
It has been submitted on behalf of the petitioner that he is in custody since 14.10.2015. Chargesheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner is not named in the F.I.R. His name has come in the confessional statement of the coaccused. He has not been put on T.I.P. to ascertain his involvement in the present case. There is no recovery of any incriminating article from the possession of the petitioner. On behalf of the State, it is submitted that petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the
Patna High Court Cr.Misc. No.30909 of 2016 (3) dt.08-09-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Ara Nawada P.S. Case no. 184 of 2015.
