The petitioner is in custody in connection with Naugachhiya Rail P.S. Case No. 30 of 2018, registered for the offence punishable under Section 379 of the Indian Penal Code and subsequently charge-sheet has been submitted under Sections 379 and 411 of the I.P.C..

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that the instant case is registered against unknown. Learned counsel for the petitioner submits that only on suspicion petitioner has been made accused in the instant case. Counsel for the petitioner submits that petitioner is in custody since 17.11.2018.
