The petitioner is apprehending his arrest in connection with Khajekalan P.S.case No.414 of 2018 , registered for offences punishable under Sections 306 of the Indian Penal Code.
Allegation as per FIR is that the informant found his daughter hanging and alleged that when he tried to talk with her but she was not talking on phone, they were teasing her and trying to make video of the same, due to which she has committed suicide.
Submission of the learned counsel for the petitioner is that there is no independent witness of the alleged allegation
Patna High Court CR. MISC. No.19638 of 2019(3) dt.19-06-2019 2/2 rather in supplementary diary neighbours have been examined, who have stated that the deceased has strained relationship with her father and due to that she has committed suicide. It is further submitted that no CDR details have been brought on record.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Patna City in connection with Khajekalan P.S.Case No.414 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid direction, this application is allowed.
