2. Both the petitioners have preferred their first regular bail application who have been arrested in connection with Noorsarai
Patna High Court CR. MISC. No.16343 of 2025(3) dt.16-05-2025 2/3 P.S. Case No. 509 of 2024 dated 01.11.2024 for the alleged offences punishable under Section 25(1-B)a, 26 & 35 of the Arms Act.
3. According to the case of prosecution, on 01.11.2024, on the basis of information received from the informant the police officials reached the spot and searched both the petitioners herein. On being searched, some live cartridges, two country made pistol and other articles were seized from their possession. Accordingly, they were arrested on 01.11.2024 and since then they are in custody.
4. It is submitted by the counsel for the petitioner that the petitioners herein are innocent and are falsely implicated in this case. He further submits that the petitioners are in jail since 01.11.2024, the charge-sheet has been submitted and trial will take some time. Therefore, it is prayed that on these grounds they may be granted benefit of bail.
5. Learned counsel appearing on behalf of respondentState opposes the prayer of bail.
6. Considering the submission made by the counsels and further considering the detention period of the applicants, I am of the view that in this case the present applicants should be granted the benefit of bail. Accordingly, both the petitions are allowed. The petitioners are directed to be released on bail in connection with Noorsarai P.S. Case No. 509 of 2024 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties, to the like amount each to the satisfaction of the learned Judicial Magistrate -
