====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 02-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 395 of the Indian Penal Code.
Allegation is that 6 to 7 unknown miscreants looted the wine shop of the informant and took away Rs.60,000/- and mobile phones of the informant and his staff.
It has been submitted on behalf of the petitioner that he is in custody since 29.4.2016. Chargesheet has been submitted against the petitioner. There is no allegation of tampering of witnesses against the petitioner. He is not named in the F.I.R. He has been made accused on the basis of his confession before the police. There is no recovery of any incriminating article from the possession of the petitioner. Petitioner has not been put on T.I.P. Other co-accused have been granted bail vide Cr. Misc. no. 33998 of 2016.
On behalf of the State, it is submitted that petitioner is not named in the F.I.R.

No.29381 of 2016 (3) dt.02-09-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Araria P.S. Case no. 26 of 2016.
