JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-04-2024 The present writ petition has been filed seeking the following reliefs:- "1(A). A writ in the nature of certiorari or any other appropriate writ/s order/s direction/s for quashing the order by which the deputation of the petitioner in Circle Office, Hajipur has been cancelled and his service has been backed to his place of posting, i.e. Circle Office, Mahnar, Vaishali and said order has not been served to the petitioner till the date, as a result, the said order
Patna High Court CWJC No.5405 of 2024(2) dt.18-04-2024 2/3 has not been brought on the record.
(B)(i). To direct the respondents to bring the order of cancellation of deputation of the petitioner on record for kind consideration of the Hon'ble Court.
(ii). To hold that the order of cancellation of the deputation of the petitioner is illegal and without jurisdiction.
(iii). To hold that handing over the charge to one Sunil Kumar, preparing the inventory, in absence of the petitioner and without any information or notice to the petitioner about the same is illegal and not sustainable in the eye of law.
(iv). To allow the petitioner to discharge his duty of work of Nazir of Circle Office, Hajipur, Vaishali, till the further order.
(v). To direct the respondent to issue a fresh order for cancellation of deputation of the petitioner in Circle Office, Hajipur, Vaishali, if they like to do so.
(vi). To dispose the application dated 12.10.2023, given by the wife of the petitioner to the District Officer, Vaishali at Hajipur."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to approach the Respondent No. 2, i.e. the District Magistrate, Vaishali at
Patna High Court CWJC No.5405 of 2024(2) dt.18-04-2024 3/3 Hajipur, for redressal of his aforesaid grievances. Liberty, so sought, is granted.
