The petitioner apprehends his arrest in connection with Sono P.S. Case No. 150 of 2016, registered for the offences punishable under Sections 272 & 273 of the Indian Penal Code and Section 47/47(A) (S)/53 of the Bihar Excise (Amendment) Act.
Allegedly, from ERTIGA Car bearing No. BR33T/0007 which belongs to the petitioner huge quantity of illegal foreign liquor was recovered and the driver and other succeeded in fleeing away.
Submission is of false implication and that the petitioner is the owner of the car, he has got no knowledge that the
Patna High Court Cr.Misc. No.5971 of 2017 (2) dt.22-02-2017 2/2 driver was transporting the wine in the car and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. opposes the prayer of pre-arrest bail.
In the facts and circumstances as stated above, considering the recovery of huge quantity of illegal wine from the car of the petitioner, I am not inclined to grant privilege of prearrest bail to him and accordingly his such prayer stands rejected in connection with Sono P.S. Case No. 150 of 2016, pending in the Court of learned Chief Judicial Magistrate, Jamui. (Jitendra Mohan Sharma, J.) Rajiv/- U T
