1. The present writ petition has been filed seeking the following relief(s):- "1(I) To remove all encroachments done by the private individuals from a piece of Gairmajarua Land appertaining to khata no. 297, plot no. 233 falling within Jhajhari village under Mainatand Block of West Champaran District as the land in question is a public road situated in front of the house of the petitioner and the encroachment over the road in question has blocked the entry and exit of the petitioner.

(II) To dispose of Encroachment Case No. 34/2021-22 in accordance with law and after passing the final

Patna High Court CWJC No.4888 of 2024(2) dt.20-06-2024 2/2 order in the said proceeding, the encroachment shall be removed forth with."

2. At the outset, the learned counsel for the petitioner seeks expeditious disposal of the pending encroachment proceedings initiated by the Circle Officer, Mainatand Block, Mainatand, District - West Champaran, vide Encroachment Case No.34 of 2021-22.

3. Per contra, the learned counsel for the respondent-State submits that in case the aforesaid encroachment proceedings are still pending, the same would definitely be concluded, within a fixed time frame, as is fixed by this Court.

4. Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the Circle officer, Mainatand Block, Mainatand, District - West Champaran to conclude the proceedings of the aforesaid Encroachment Case No.34 of 2021-22, by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, in case the same has not already been passed, in accordance with law and after hearing the affected parties, within a period of six weeks of receipt/production of a copy of this order.
