The petitioner is languishing in custody for the offences punishable under Sections 376/354(c)/384/ 313 /370A / 506/34 of the Indian Penal Code.
According to FIR, the informant aged about 19 years was in love with the petitioner and the petitioner was in physical relation with her. On 28.12.2019 the petitioner married with the informant through an affidavit sworn before the Notary Public. However, the informant married with another man subsequently. Learned counsel for the informant submits that the informant has already married with another person vide affidavit at Annexure-3, sworn by the informant and that person, on 16.12.2019. The affidavit also shows that the informant had love

Considering the nature of material, let the petitioner, above named, who is in custody since 28.12.2020, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Araria Mahila P.S. Case No. 104 of 2020 with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
