The petitioner seeks bail in a case instituted under Section 384 of the Indian Penal Code.

The prosecution story, in brief, is that while the informant was going to his home, after shutting down his shop, Rs. 25 lacs was demanded from him as rangdari from the caller of the phone and on 28.03.2016, the caller threatened the informant with dire consequences on not fulfilling the demand and told that he is calling from Indian Marxist Party.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 06.04.2016. The charge sheet has been submitted in the present case. There is no allegation of

Patna High Court Cr.Misc. No.35182 of 2016 (3) dt.19-10-2016 2/2 tampering of witnesses alleged against the petitioner. The petitioner is not named in the First Information Report. He has been made accused on the basis of confessional statement of coaccused. There is no other substantive evidence to suggest his implication in the present case.

On behalf of the state, it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Saran at Chapra, in connection with Parsa P.S. Case No. 52 of 2016.
