2. The petitioner is in custody since 19.02.2016 in connection with Arwal P.S. Case No. 56 of 2015 for the offences alleged under Sections 394 and 302 of the Indian Penal Code and Section 27 of the Arms Act.
3. It is submitted that the petitioner has been falsely implicated merely on the basis of the confessional statement of coaccused Vikash Kumar. He has not been put on test identification parade and no incriminating goods have been recovered from his conscious possession. Similarly situated co-accused Roushan Kumar @ Laddu @ Laddu Kumar @ Laththu Kumar has been granted bail by this Court in Cr. Misc. No. 17403 of 2016.
4. Having regard to the entirety of the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal in connection with Arwal P.S. Case No. 56 of 2015 with following conditions:
(1) That one of the bailors will be a close relative of the
Patna High Court Cr.Misc. No.32885 of 2016 (2) dt.18-08-2016 2/2 petitioner;
(2) That the petitioner shall remain physically present on each and every date during trial and in the event of failure to do so on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the Court concerned. (Vikash Jain, J) B.T/-Ibrar U T
