The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner has antecedent of one case and the informant alleges that on 07.02.2018 at about 7.00 O' clock, he had parked his vehicle near his office, but when he came back, the vehicle was missing. It is next alleged that owner of the vehicle is one Brajesh Kumar, as such, it is alleged that unknown thief committed the occurrence.

The learned counsel for the petitioner submits that the F.I.R. was against unknown. It is next submitted that the name

Patna High Court CR. MISC. No.20199 of 2022(3) dt.22-11-2022 2/3 of the petitioner transpired during the course of investigation as petitioner was a named accused in Laheriasarai P. S. Case No.54 of 2018. The learned counsel next submits that petitioner will cooperate in the investigation and the present himself as and when required by the Investigating Officer of the case. Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Laheriasarai P. S. Case No.50 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.

However, if the Investigating Officer of the case files an application before the learned trial Court bringing to its notice that petitioner is not cooperating in the investigation nor has presented himself as and when called, the learned trial Court after hearing the petitioner shall pass order in accordance with

The learned trial Court is directed to send a copy of this order to the concerned Police Station.
