JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 03-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the informant/opposite party no.2.

The petitioner apprehends his arrest in connection with Fulwari Sharif P.S. Case No.506 of 2016 registered under Sections 498(A)/34 of the Indian Penal Code besides Sections 3/4 of the Dowry Prohibition Act.

Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner, who is the husband of the informant/opposite party no.2, is ready to keep his wife (the informant/opposite party no.2) with full honour and dignity and

Patna High Court Cr.Misc. No.4531 of 2017 (4) dt.03-04-2017 2/2 the petitioner has also filed Matrimonial (Restitution) Case No.9 of 2016, which is pending in the court of the Principal Judge, Family Court, Sheikhpura. Now, the informant/opposite party no.2 is residing with the petitioner.

Learned counsel for the informant/opposite party no.2 submits that the informant/opposite party no.2 is residing with the petitioner for the last one month.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Ms. Shema Eram, Judicial Magistrate, First Class, Patna, in connection with Fulwari Sharif P.S. Case No.506 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
