The petitioner apprehends his arrest in Naubatpur P.S. Case No. 694/2015, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code. The informant alleged that while he was returning from market Raghubir Verma and his brother Rishi Verma (petitioner) caught him. Raghubir Verma assaulted the informant with Farsa on his head. Petitioner is also alleged to have assaulted the informant with lathi on his back.

It is submitted that there is counter version bearing Naubatpur P.S.Case No. 695/2015. The informant got one lacerated wound on the head and complain of pain in left shoulder, but there was no visible injury. Injury no. 2 on left shoulder is opined to be simple in nature. Regarding Injury no. 1 opinion is

Patna High Court Cr.Misc. No.30351 of 2016 (2) dt.15-09-2016 2/2 kept reserved. Raghubir Verma has already been enlarged on bail vide order passed in Cr. Misc. 8215/2016.

It appears that there is a case and counter case. Petitioner is alleged to have assaulted the informant with lathi on his back, but no visible injury was found.

Considering the facts aforesaid and the fact that Raghubir Verma has already been enlarged on bail, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate Ist Class, Danapur in connection with Naubatpur P.S. Case No. 694/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
