The petitioner is languishing in custody since 08.05.2016 in a case registered for the offences punishable under Sections 8 and 20 of the NDPS Act.

The prosecution case is that two persons were coming on a motorcycle, who subsequently disclosed their name as petitioner as well as co-accused Nazbul Haque, and from the dicky of the motorcycle 1 Kg. ganja was recovered. It is submitted by learned counsel for the petitioner that the recovery is of small quantity and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Patna High Court Cr.Misc. No.31827 of 2016 (2) dt.16-08-2016 2/2 concluded and similarly situated co-accused Nazbul Haque has been granted bail by this Court vide Cr. Misc. No. 27448 of 2016. Mr. J.N. Thakur, learned counsel for the State, does not controvert the quantity of recovery. Considering the nature of recovery, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Araria in connection with Special Case No. 16 of 2016 arising out of Jokihat P.S. Case No. 119 of 2016.
