JUSTICE BIRENDRA KUMAR ORAL ORDER 17-02-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 341, 323, 308, 385, 337, 379 and 504 of the Indian Penal Code. There is general and omnibus allegation against the petitioners and others that they committed assault and theft, for land dispute between the parties. There is counter case also wherein the accused persons have already been allowed anticipatory bail.
Learned counsel for the informant opposed the prayer for bail.
Considering the general and omnibus nature of
Patna High Court Cr.Misc. No.4033 of 2017 (2) dt.17-02-2017 2/2 allegation, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya/Successor Court in connection with Delha Police Station Case No. 184 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
