Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks regular bail in connection with S.T. Excise 392 of 2023 arising out of Ratanpura P.S. Case No. 07 of 2023 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018. Learned counsel for the petitioner submits that the there is recovery of 374 bottle of 300 ml. illicit Nepali liquor and also the petitioner is in custody since 02.02.2023. The petitioner has no criminal antecedent.

Learned APP has vehemently opposed the prayer for bail.

Patna High Court CR. MISC. No.21053 of 2023(2) dt.22-05-2023 2/2 Considering the nature of allegation levelled against the petitioner, his period of custody and his clean antecedent, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned In-charge Exclusive Special Judge, Excise, Court No. 2, Supaul in connection with S.T. Excise 392 of 2023 arising out of Ratanpura P.S. Case No. 07 of 2023.
