The petitioner apprehends his arrest in connection with Baniyapur P.S. Case No.501 of 2021 registered for offences under Sections 30(a), 38 and 45 of the Bihar Prohibition and Excise Act.
Considering the facts and circumstances of the case, this application for anticipatory bail is allowed. Accordingly, let petitioner, above-named, in the event of his arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Saran in connection with Baniyapur P.S. Case No.501 of 2021, subject to
Patna High Court CR. MISC. No.20546 of 2022(2) dt.29-04-2022 2/2 the conditions as laid down under Section 438(2) of the Cr.P.C. and subject to further condition that the petitioner will deposit a sum of Rs.10,000/- in the Charitable organization like District Legal Aid Committee, Saran at Chapra. The court below will accept the bail bond of the petitioner only after verifying the fact that the petitioner has deposited Rs.10,000/- in the account of District Legal Aid Committee, Saran at Chapra. In default in payment of the aforesaid amount in the account of District Legal Aid Committee, Saran at Chapra, bail bond of the petitioner shall stand automatically cancelled and he shall be taken into custody forthwith.
