In this case, the petitioner is challenging the order dated 17th February 2012 passed in S.Tr. Case No. 463/2009 arising from Chautarwa P.S. Case No. 24/2006 by which the court below has rejected the discharge application of the petitioner. The prosecution case is that the informant constructed a house of bamboo and straw. Allegation has been made that men of the informant and workers were confined in that house and set the same under fire with intention to kill them. Anyhow informant's men and others in that house could escape and saved their life.
Allegation has been made, the hut has been burnt along with articles lying in that house.
The court below examined paras 7, 8, 9, 10 and 11 of
Patna High Court Cr.Misc. No.46943 of 2012 (3) dt.23-04-2015 2/2 the case diary and found that the sufficient material against the petitioner implicating him in the present case. This Court does not find any error in the impugned order. Accordingly this petition is dismissed. (Shivaji Pandey, J) Mahesh/- U T
