The petitioner is apprehending his arrest in connection with Raushanganj (Bankey Bazar) P.S.Csae no. 109 of 2018 , registered for offences punishable under Sections 341, 323, 324, 325, 307, 504, 506/34 of the Indian Penal Code. Allegation against the petitioner is of assault by lathi to the mother of the informant.
Submission of the learned counsel for the petitioner is that the FIR itself shows that the dispute is with respect to partition and the injuries are simple in nature. It has further been submitted that by mistake it has been mentioned as serious injuries.

No.18996 of 2019(2) dt.06-05-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, surrender before the court below within a period of six weeks from the date of receipt of order and the learned court below shall verify the injuries to the mother of the informant and if the injuries are simple he will release the petitioner ono bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Sherghati District Gaya in connection with Raushanganj (Bankey Bazar) P.S.Case no.109 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid direction, this application is allowed.
