JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-10-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 494 and 498A of the Indian Penal Code.
The basic accusation is of torture and performing second marriage.
It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the informant. Though, the petitioner also admits second marriage but he is ready to maintain the informant.
Since the petitioner has performed second marriage, this Court is not inclined to grant anticipatory bail to the petitioner.
Patna High Court Cr.Misc. No.28866 of 2016 (3) dt.21-10-2016 2/2 Let the learned court below consider the prayer for bail of the petitioner if he surrenders within a period of six weeks in connection with Narhat (Sitamarhi) P.S. Case No. 155 of 2015 pending in the court of learned CJM, Nawada.
Accordingly, the application is disposed of.
