Petitioner prays for bail in connection with Manigachhi P.S.Case No. 250 of 2017, corresponding to C.R.I. Case No. 3554 of 2017, registered for the offences punishable under Sections 420, 414, 467, 468 and 120B of the Indian Penal Code. Allegation against the petitioner is of using the vehicle with fake number and it appears from the impugned order that later on it is come that petitioner has been given the papers of the car by Dr. Rajesh Kumar Jha for transfer of owner book but instead of transferring of the vehicle he was using the same by fake number.
Submission of learned counsel for the petitioner is that co-accused persons have been granted bail vide order dated 13.4.2018 passed in Cr.Misc.No. 21414 of 2018 and petitioner is
Patna High Court Cr.Misc. No.60723 of 2018 (2) dt.06-10-2018 2/2 in custody since 14.12.2017, having no criminal antecedent. Heard learned APP also.
Having heard both sides and in the facts and circumstances and considering the fact that petitioner is in custody for nine months and he has no criminal antecedent, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Darbhanga, in connection with Manigachhi P.S.Case No. 250 of 2017, corresponding to C.R.I. Case No. 3554 of 2017, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that if petitioner is involved in such type of cases in future, his bail bond shall be cancelled.
