====================================================== CORAM: HONOURABLE MR. JUSTICE SOURENDRA PANDEY ORAL ORDER 20-06-2025 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. The petitioners seek regular bail in a case registered for the offences under Sections 103 and 3(5) of B.N.S. Petitioners have clean antecedent.

3. As per the FIR, the informant, namely, Karuna Kumari has alleged that all the named accused persons including the petitioners have assaulted the mother-in-law of the informant stating her to be a daain. Later the mother-in-law of the informant was found dead on her bed and there was a black mark on her neck.

4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this

Patna High Court CR. MISC. No.19472 of 2025(3) dt.20-06-2025 2/3 case merely on the ground of suspicion. Learned counsel further submits that there is no eye witness to the alleged occurrence. It is lastly submitted that the petitioners are having clean antecedent and they are in judicial custody since 30.09.2024. It has also been submitted that similarly situated co-accused persons have already been granted bail by this Court vide order dated 16.05.2025, passed in Criminal Misc. No. 6963 of 2025.

5. Learned counsel for the State has opposed the prayer for bail of the petitioners and submits that the mother-inlaw of the informant died in mysterious circumstances and even in the post-mortem report no concrete evidence has come as to what was her cause of death.

Considering the aforesaid facts and circumstances of the case and taking into account that there is general and omnibus allegation against the petitioners and also considering the period of custody of the petitioners, let the petitioners abovenamed be enlarged on bail on each of them furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Imamganj P.S. Case No. 278/2024 subject to the conditions:- a. One of the bailors of the petitioners shall be their

b. The petitioners shall remain physically present in Court on each date of the trial.

c. In case of absence on two consecutive dates or in violation of the terms of the bail, the bail bond of the petitioners will be liable to the cancelled by the court concerned. d. The learned Court below shall verify the criminal antecedent of the petitioners and in case at any stage it is found that the petitioners have concealed their criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioners. However, the acceptance of bail bonds in terms of the aforementioned order shall not be delayed for purpose of or in the name of verification.

7. It is made clear that the observations, if any, made in this order, shall be of no bearing during the trial. (Sourendra Pandey, J) Siwani/- U T
