The petitioner seeks bail in a case instituted for the offences under Section 392 of the Indian Penal Code. Prosecution case, in short, is that that while the informant was going to his school, accused persons took his motorcycle and handed over another motorcycle to him and fled away.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.09.2018. Chargesheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The name of the petitioner has transpired on the basis of confessional statement of co-accused namely Raju Paswan.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IV, Kaimur at Bhabhua in connection with Chand P.S. Case No. 40 of 2017.
