JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302, 201/34 of the Indian Penal Code. Petitioner is named in the first information report on the ground that earlier the petitioner had illicit relation with the deceased but later on, he deserted the deceased who called a Panchayati, in which, the petitioner was directed to make payment of Rs. 500/- per month to the deceased but the petitioner did not make any payment to the deceased and subsequently, on the alleged date of occurrence, the dead body of the deceased was found.

Submission on behalf of the petitioner is that except

Patna High Court Cr.Misc. No.34368 of 2016 (2) dt.20-08-2016 2/2 the confessional statements as well as suspicion, there is nothing against the petitioner and moreover, co-accused Makesar Yadav @ Makeshar Yadav, in whose confessional statement, the name of petitioner came in this case, has already been granted privilege of bail by a coordinate bench of this court.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mehus P.S. Case No. 02 of 2016 to the satisfaction of Sri Jigar Sah, J.M.-Ist Class, Sheikhpura. (Hemant Kumar Srivastava, J) A.K.V./- U T
