2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 324, 308, 504/34 of the Indian Penal Code.

3. As per prosecution case, on 16.03.2022 at about 10:30 AM, these petitioners along with other F.I.R. named accused persons came at the house of informant and requested to resolve the dispute and when informant along with his brothers went to the house of these petitioners, the accused persons assaulted informant and his brothers by means of farsa, spade, etc.

4. Learned counsel for the petitioners submits that both parties are co-villagers and due to on-going land dispute, a quarrel took place. Allegation of assault is general and omnibus and there is no specific allegation of overt act against petitioners. Injuries allegedly caused by these petitioners are simple in nature. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of accusation, simple injury and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Jhanjharpur, Madhubani in connection with Laukahi (Narahiya OP) P. S. Case No. 70 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
