JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is a P.D.S dealer and it is stated that the informant seized 87 bags of wheat weighing 43.5 quintals, while petitioner was making attempt to remove the aforesaid wheat with an intention to sell the same in black market. Submission on behalf of the petitioner is that the present case has been lodged at the behest of local Mukhiya with whom petitioner has enmity. It is further submitted that the seized wheat has, admittedly, been recovered in front of shop of the petitioner and, moreover, petitioner is in jail custody since 25.05.2016.

Accordingly, let the petitioner, above named, be

Patna High Court Cr.Misc. No.30684 of 2016 (2) dt.08-08-2016 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ara in connection with Azimabad P.S.Case No. 16 of 2016.
