JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-09-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 353, 307, 504 and other allied sections of the Indian Penal Code. As per the prosecution case, when the police party proceeded with arrested co-accused, Pakauri Singh, who was absconding in Giriyak Police Station Case No. 299 of 2020, all the FIR named accused persons including the petitioner abused the police men, pelted stones, bricks etc. and attacked on them with lathi, danda. It is further alleged that accused persons also managed to free Pakauri Singh from the police custody. It is submitted on behalf of the petitioner that allegation of abuse and assault is general and omnibus and no specific overt act has been alleged against this petitioner.

Patna High Court CR. MISC. No.21031 of 2022(2) dt.05-09-2022 2/2 Injuries found on the person of injured are simple in nature. Similarly situated co-accused have been granted bail by this Court vide order dated 25.07.2022 passed in Cr. Misc. No. 1369 of 2022 and dated 25.08.2022 passed in Cr. Misc. No. 64885 of 2021.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif in Giriyak (Pawapuri) Police Station Case No. 300 of 2021, subject to the conditions laid down under sections 438(2)of the Code of Criminal Procedure.
