JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 394 of the Indian Penal Code.

Petitioner is named in the first information report but the informant claims that he came to know about the name of petitioner and co-accused on the basis of conversation of the culprits and after the occurrence, he went to the house of the petitioner and co-accused and identified them . The first information report reflects that the petitioner was not known to the informant prior to the alleged occurrence and for the first time, the informant came to know about the name of the petitioner on the basis of conversation as alleged in the first

It is surprisingly enough that after the occurrence, informant located the father's name and address of the petitioner. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 29.2.2016. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Jamui in connection with Jhajha P.S.
