The petitioner seeks bail in Samastipur (Town) P.S. Case No. 230 of 2018, instituted for the offence under Section(s) 395 and 397of the Indian Penal Code. Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade has been held. The name of petitioner has come in the confessional statement of co-accused Md. Kalim. Counsel for the petitioner further submits that co-accused Sunny Kumar with similar allegation has already been granted bail by coordinate Bench of this Court vide order dated 14.02.2019 passed in Cr. Misc. 8866 of 2019.

Petitioner is in custody since 21.09.2018.

Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur, in connection with Samastipur (Town) P.S.
