In this application for anticipatory bail the petitioner apprehends his arrest in connection with Bakhri P.S. Case No. 281 of 2013 for the offences punishable under sections 419, 420 and 468/34 of the I.P.C.

From perusal of the impugned order it reveals that in this case co-accused Pankaj Kumar has been granted anticipatory bail on 16.01.2014 and as the petitioner applied for pre-arrest bail after 2 1⁄2 years, his application has been rejected considering that there is no apprehension of arrest of the petitioner. It is submitted that the petitioner is simply a witness on the sale deed, he has no concern with the alleged offence and the case of the petitioner is on better footing.

In the facts and circumstances as stated above, considering that co-accused Pankaj Kumar has been allowed prearrest bail by the learned court below itself and as such the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. A.C.J.M. Bakhri, Begusarai in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
