JUSTICE RAVI RANJAN ORAL ORDER 06-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offences under Sections 272, 273 and 308/34 of the Indian Penal Code and Sections 30, 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 25.20 litres of foreign liquor and 8.6 litres of country-made liquor was recovered from the dickey of the Maruti Suzuki. It is contended that the petitioner has no concern with the alleged illicit liquor. Nothing has been recovered from the conscious possession of the petitioner. Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Siwan in connection with Mairwa P.S. Case No. 249 of 2018 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
