The petitioner is accused in connection with Barhat P.S. Case No. 32 of 2016, registered under Section 366(A) of the Indian Penal Code.
The accusation is of kidnapping of daughter of the informant by one Rupesh Kumar as well as this petitioner Learned counsel for the petitioner submits that the informant has detailed the name of the petitioner in his fardbeyan with allegation of kidnapping of his daughter, but it would appear from the statement of victim, daughter of the informant, recorded under 164 Cr.P.C. that she left house according to her sweet will and performed marriage with Rupesh Kumar and she also showed her willingness to live with Rupesh
Patna High Court Cr.Misc. No.34093 of 2016 (2) dt.17-08-2016 2/2 Kumar. Further submission is that in the said statement recorded under Section 164 Cr.P.C., the age of the victim was assessed as 16 years and she herself disclosed her age as 19 years. The petitioner having no criminal antecedent is in custody since 23.06.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st Class, Jamui in connection with Barhat P.S.
