JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-05-2019 This is an application for grant of anticipatory bail in connection with Tatarpur (University) P.S. Case No. 264 of 2018, disclosing offences under Sections 147, 148, 149, 341, 323, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner and other accused persons is of assault to the informant and try to lift him on the Scooty on the gun point and while fleeing away, the petitioner fired, which hit on his thigh.
Submission of learned counsel for the petitioner is that the informant and others have fired on the petitioner, which hit on the thigh of the petitioner and for saving his skin, the present false case has been lodged against the petitioner and is statement was recorded on the hospital, on the basis of which a
Patna High Court CR. MISC. No.19808 of 2019(2) dt.07-05-2019 2/2 counter case has been lodged.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 7th Bhagalpur, in connection with Tatarpur (University) P.S. Case No. 264 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
